Este artículo caracteriza procesos identitarios sucedidos en escuelas públicas. ¿Hubo oportunidades para referencias que no fueran las moldeadas por la lógica nacional de fines del siglo XIX y principios del siglo XX? ¿Es posible trazar una periodización que señale cambios en torno al tema? El análisis se centra en las décadas que van de 1860 a 1880, pero ofrece una perspectiva de más largo plazo integrando lo sucedido desde el período postindependiente. En ese contexto se reconstruyen experiencias ligadas al vínculo (...) entre escolarización, indígenas e inmigrantes transoceánicos. Al hacerlo se recuperan aspectos ligados a lo étnico, a la religión, a la presencia de banderas y símbolos patrios en las aulas. Un heterogéneo grupo de rasgos que, en conjunto, fundamentan la crítica que se hace al lugar común que asocia escuelas elementales y construcción de la nacionalidad. El texto se organiza en seis partes: una introducción, un recorrido por bibliografía que se ha abocado a estos asuntos, un apartado trazando rasgos sobre el tema reconocibles desde el temprano siglo XIX, un fragmento abocado al vínculo entre indígenas y escuelas, otro atiende a asuntos algo heterogéneos ligados a temáticas identitarias para, finalmente, concluir. Estos temas son tratados, fundamentalmente, a partir de fuentes generadas en escuelas públicas, mayormente para varones, de la campaña de Buenos Aires y conservadas en el fondo de la Dirección General de Escuelas del Archivo Histórico de la Provincia de Buenos Aires. El presente trabajo trata sobre responsabilidad extracontractual y toma como objeto de análisis un caso real que no quiere ser revisado por el Gobierno boliviano, desde la perspectiva de la responsabilidad, puesto que él mismo adquirió carga por culpa sobre un accidente aéreo de una nave y que, con el evento fatídico provocado, involucró a tres países: Bolivia, Colombia y Brasil; este último como principal afectado puesto que los pasajeros que fallecieron en el accidente eran de dicha nacionalidad. IntroductionCardiology is characterized by its state-of-the-art biomedical technology and the predominance of Evidence-Based Medicine. This predominance makes it difficult for healthcare professionals to deal with the ethical dilemmas that emerge in this subspecialty. This paper is a first endeavor to empirically investigate the axiological foundations of the healthcare professionals in a cardiology hospital. Our pilot study selected, as the target population, cardiology personnel not only because of their difficult ethical deliberations but also because of the stringent conditions in which they (...) have to make them. Therefore, there is an urgent need to reconsider clinical ethics and Value-Based Medicine. This study proposes a qualitative analysis of the values and the virtues of healthcare professionals in a cardiology hospital in order to establish how the former impact upon the medical and ethical decisions made by the latter.ResultsWe point out the need for strengthening the roles of healthcare personnel as educators and guidance counselors in order to meet the ends of medicine, as well as the need for an ethical discernment that is compatible with our results, namely, that the ethical values developed by healthcare professionals stem from their life history as well as their professional education.ConclusionWe establish the kind of actions, communication skills and empathy that are required to build a stronger patient-healthcare professional relationship, which at the same time improves prognosis, treatment efficiency and therapeutic adhesion. Se examina la noción de espectro, propuesta en Espectros de Marx, para evidenciar la problematización que Jacques Derrida hace a la oposición, que se supone tajante, entre las nociones de vida y muerte. Se evidencia que Derrida no traza tal problematización exclusivamente a partir de Espectros de Marx, sino también desde diversos textos que dan cuenta de un constante asedio que ronda su pensamiento: la sobrevida. A su vez, se analiza la discusión que Derrida sostuvo con el espectro de Marx (...) para evidenciar: (1) de qué modo la herencia fiel-infiel de Marx contribuye al pensamiento de la sobrevida; (2) cómo en tal pensamiento de la sobrevida se inscribe necesariamente el problema de la justicia y la alteridad. This paper provides a detailed analysis of how, according to Kant, the moral badness of some third parties’ actions can be established with certainty (by anyone, not only by the agent’s own conscience or by God). This account helps clarify why Kant affirms that some forms of wrongdoing (of which there are a “multitude of woeful examples”) can be demonstrated to be immoral, while excluding the possibility of proving the moral goodness of any action. Bus bunching is ostensibly regarded as a detrimental phenomenon in bus systems. We study a bus loop with two bus stops, one regular bus stop and one spike bus stop, where bunched buses can outperform staggered buses. The spike bus stop models a bus stop connected to a train or metro service, where passengers arrive in groups at periodic intervals. We introduce the configuration of synchronised bunched buses, where bunched buses wait for the spike in demand. For a wide range (...) of parameters, synchronised bunched buses outperform perfectly staggered buses in terms of minimising the waiting time of commuters. We present an analytical formulation of the average waiting time in the case of bunched buses, synchronised bunched buses, and perfectly staggered buses with the consideration of different passenger demands, number of buses, and bus capacity. We demonstrate the validity of our analytical results through an agent-based simulation of the bus loop system. (shrink)

En los procesos de identificación social muchas veces la valoración del pasado resulta fundamental. La existencia objetiva de esa valoración ha propiciado que distintos actores sociales, en diferentes momentos históricos, hayan hecho uso del pasado en la estructuración de las ideologías que sustentan los procesos de identificación y, en consecuencia, sus propios proyectos políticos. Es decir, los mitos políticos están compuestos manifiestamente de dos componentes básicos. Por un lado, consisten en la así llamada política simbólica y por el otro lado, (...) son parte de la memoria colectiva. Es por esto que los mitos se enfrentan con las bases mismas del proyecto de modernidad, quizás la razón por la cual sea la politología la disciplina de las ciencias sociales que menos los ha estudiado. La utopía andina, el mahdi o el doceavo imán, el emperador alemán oculto y dormido y el bolivarianismo, constituyen algunos estos mitos políticos. (shrink)

En el contexto del sistema presidencial chileno, el artículo analiza el rol del Congreso en la elaboración de la política exterior, desde la perspectiva del enfoque transaccional desarrollado por Pablo Spiller y Mariano Tommasi (2000). De este modo, se plantea que el trabajo del Congreso en general, y de las comisiones de Relaciones Exteriores del Senado y de la Cámara de Diputados en particular, se caracteriza por la permanencia y continuidad de los miembros y, en consecuencia, por un trabajo especializado (...) y de alta calidad profesional, lo que favorece la cooperación entre los actores y los intercambios intertemporales entre éstos. In this article, we rebuild the reading of Benjamin’s Critique proposed by Menke and consider the appropriateness of violence in the law not as a tragic tension, but as a condition for its reproduction. Este artículo pretende generar claridades sobre el planteamiento sistémico, llevado a los universos de la escuela y la familia. Se plantean lugares de encuentro entre estos dos sistemas interconexionados por el pensamiento sistémico y la comunicación, rescatando que la escuela y la familia han sido determinantes en la configuración de subjetividades y sociedades. Estas reflexiones permiten concluir que las manifestaciones recíprocas de la familia y la escuela esculpen maneras de ser y de estar en el mundo.

The Gamer's Dilemma challenges us to find a distinction between virtual murder and virtual pedophilia. Without such a distinction, we are forced to conclude that either both are morally acceptable or that both should be morally illicit. This paper argues that the best way to solve the dilemma is, in one sense, to dissolve it. The Gamer's Dilemma rests on a misunderstanding in the sense that it does not distinguish between the form of a simulation and its surface content. A (...) greater appreciation of the way structural features of a simulation affect subject experience will help us see why only simulations of murder and pedophilia generating virtually real experiences are likely to be seen as wrong. I argue that a simulation’s structural elements powerfully affect how subjects experience simulated content and hence is an important, and previously neglected, variable necessary to dissolve the Gamer's Dilemma. Properly understood, virtually real simulations of murder and pedophilia are both likely to be treated by players as morally wrong. Similarly, virtually unreal murder and pedophilia will be less likely to be judged as wrong. Subject judgments are thus consistent once a simulation’s structural variables are accounted for. The Gamer's Dilemma dissolves as a dilemma once we acknowledge these structural features of simulations and how they affect experience and moral judgment. (shrink)

El uso de sistemas de machine learning en los procesos de selección laboral ha sido de gran utilidad para agilizarlos y volverlos más eficientes, pero al mismo tiempo ha generado problemas en términos de equidad, confiabilidad y transparencia. En este artículo comenzamos explicando los diferentes usos de la Inteligencia Artificial en los procesos de selección laboral en Estados Unidos. Presentamos los sesgos sexuales y raciales que han sido detectados en algunos de ellos y explicamos los obstáculos jurídicos y prácticos para (...) su detección y análisis. Un posible remedio jurídico a la discriminación algorítmica es el régimen de impacto diferencial sistémico utilizado en Estados Unidos. Usamos algunas características de este régimen para señalar los vacíos jurídicos frente a la discriminación en el acceso al empleo en el ámbito del derecho laboral colombiano, y ofrecemos algunas características generales que podría tener un régimen de esa naturaleza. This book provides theoretical tools for evaluating the soundness of arguments in the context of legal argumentation. It deals with a number of general argument types and their particular use in legal argumentation. It provides detailed analyses of argument from authority, argument ad hominem, argument from ignorance, slippery slope argument and other general argument types. Each of these argument types can be used to construct arguments that are sound as well as arguments that are unsound. To evaluate an argument correctly (...) one must be able to distinguish the sound instances of a certain argument type from its unsound instances. Hrushovski proved that the theory of difference-differential fields of characteristic zero has a model-companion, which we shall denote DCFA. Previously, the author proved that this theory is supersimple. In supersimple theories there is a notion of rank defined in analogy with Lascar U-rank for superstable theories. It is also possible to define a notion of dimension for types in DCFA based on transcendence degree of realization of the types. In this paper we compute the rank of a model of DCFA, (...) give some properties regarding rank and dimension, and give an example of a definable set with finite rank but infinite dimension. Finally we prove that for the case of definable subgroup of the additive group being finite-dimensional and having finite rank are equivalent. (shrink)

Purpose: Empirical studies suggest that corporate social responsibility impacts young job seekers’ choices of an employer. Values seem to affect CSR preferences, influencing the felt fit between the person and the organization and hereby the valence of working for that company. This article aims to research in more detail the preference structure of young graduate job seekers. In particular, it seeks to understand whether CSR is important when there is a trade-off between CSR and non-CSR attributes and whether basic value (...) orientations of job seekers have a moderating effect on their employer preferences. Design/methodology/approach: This article used a quantitative approach with a survey sample of 577 German students who were in their last year of study. To gain information on the relative impact of CSR- and non-CSR-related employer characteristics on employer attractiveness, an adaptive conjoint analysis was applied. Correlation analysis and a two-step hierarchical regression were conducted to detect the effects of individual value orientations. Findings: Only a few CSR attributes are relevant for young job seekers compared with other traditional employer attributes. Specific value orientations can be identified as having a moderating effect on CSR preferences. This is particularly the case for value orientations indicating a concern for the welfare of others and the environment positively affect the importance of most CSR attributes while more selfish value orientations have a negative effect. Originality/value: This study sheds light on the relative importance of CSR attributes when compared with non-CSR attributes. Moreover, it relates employee-related preferences to individual value orientations and shows that selected values have a modifying effect on the importance of CSR for job choice. (shrink)

En este artículo se estudia la conexión entre tecnología social e innovación oculta a partir de un conjunto de vectores éticos. Estos vectores éticos permiten que aflore y se difunda la innovación oculta que se produce a través de la tecnología social en entornos colaborativos. Entender la dimensión ética de la tecnología social permite identificar el papel que juega un conjunto de leyes (ley de Metcalfe, ley de rendimientos crecientes de adopción y ley de externalidades positivas) en el desarrollo de (...) prácticas de empoderamiento social en dichos entornos, definidos como "comunidades de conocimiento". Se analizan estos vectores éticos presentes en la tecnología social a partir de las siguientes categorías: conocimiento e innovación comunitarios, participación ciudadana y democracia, diálogo entre saberes populares y saberes científicos, y proceso pedagógico holístico. Jair Bolsonaro, the current President of Brazil, has made himself into one of the most influent advocates of COVID-19 denial. His health policy and his political doctrine are partly based on an implicit moral claim, which is neglected by contemporary political theory. Bolsonarism’s rhetoric raises a moral claim to freedom without responsibility, which relieves its followers from the burdens that emerge from liberal accounts of liberty or from basic goods accepted in a political community. In opposition to liberal or communitarian (...) accounts, Bolsonarism endorses a Hobbesian concept of freedom that describes it as the absence of ‘impediments to motion’. Nonetheless, it differs from Hobbes because it treats this liberty as endowed with moral value and non-negotiable through a social contract. (shrink)

This paper argues that, while there is a difference between personal and sub-personal explanation, claims of autonomy should be treated with scepticism. It distinguishes between horizontal and vertical explanatory relations that might hold between facts at the personal and facts at the sub-personal level. Noting that many philosophers are prepared to accept vertical explanatory relations between the two levels, I argue for the stronger claim that, in the case of at least three central personal level phenomena, the demands of explanatory (...) adequacy require postulating horizontal explanatory relations. Indigenous conservation through patrimonialization is the product of political and legal decisions made by a non-indigenous agent: the liberal state, using the law to retain a form of bios. We propose that patrimonialization is the device by which liberal states have processed and integrated indigenous claims into a form of bios ultimately designed to safeguard state legal structures. We argue that, to uphold the rule of law in contexts (...) of struggle and resistance that challenge the very understanding of the law, states respond by wielding the law in the form of the rule by law, that is, pushing the law to the limit to give normative content to the criteria by which the state conducts its affairs, without straying from the individual rights framework. We hold that the rule by law is an operation that defines the patrimonialization of indigenous peoples. It increases their visibility while imposing limits on political action to keep them from becoming sui juris subjects capable of breaching the distinction between zoe and bios. In this article, we try to understand the political–ideological intent of these decisions, the intentions beyond the letter of the law of patrimonialized peoples. (shrink)

Corporate America is institutionalizing ethics through a variety of structures, systems, and processes. This study sought to identify managerial perceptions regarding the institutionalization of ethics in organizations. Eighty-six corporate level marketing and human resource managers of American multi-national corporations responded to a mail survey regarding the various implicit and explicit ways by which corporations institutionalize ethics. The results revealed that managers found ethics to be good for the bottom line of the organizations, they did not perceive the need for additional (...) formalization of ethics, and that they perceived implicit forms of institutionalizing ethics (e.g., leadership, corporate culture, top management support) to be more effective than the explicit forms of institutionalizing ethics (e.g., ethics ombudspeople, ethics committees, ethics newsletters). This paper aims to outline an analysis and interpretation of the process that led to First-Order Logic and its consolidation as a core system of modern logic. We begin with an historical overview of landmarks along the road to modern logic, and proceed to a philosophical discussion casting doubt on the possibility of a purely rational justification of the actual delimitation of First-Order-Logic. On this basis, we advance the thesis that a certain historical tradition was essential to the emergence of (...) modern logic; this traditional context is analyzed as consisting in some guiding principles and, particularly, a set of exemplares (i.e., paradigmatic instances). Then, we proceed to interpret the historical course of development reviewed in section 1, which can broadly be described as a two-phased movement of expansion and then restriction of the scope of logical theory. We shall try to pinpoint ambivalencies in the process, and the main motives for subsequent changes. Among the latter, one may emphasize the spirit of modern axiomatics, the situation of foundational insecurity in the 1920s, the resulting desire to find systems well-behaved from a proof-theoretical point of view, and the metatheoretical results of the 1930s. Not surprisingly, the mathematical and, more specifically, the foundational context in which Firs-Order-Logic matured will be seen to have played a primary role in its shaping. (shrink)
